Last week the FCC made it official: they’ve opened a new docket—that would be 11-65—for the “proposed transfer of control of T-Mobile USA, Inc. and its subsidiaries from Deutsche Telekom AG to AT&T Inc.”
Let the ex-parte comments and presentations flow.
But wait a sec … until the parties formally submit an application, “communications directed to the merits of the outcome of a proceeding” can be made without any limitation.
In other words, the relevant attorneys can, for now, freely make their pitches to the Commission in private.
After the application for the T-Mobile purchase is received, their presentations fall under the usual “permit-but-disclose” rules, wherein we the public get a hint at what’s discussed at FCC headquarters.
